What Is Probate?

The term probate refers to the process that courts use to determine how the assets in a person’s estate are distributed after he or she passes away. In most cases, the probate process includes:

  • Finding a person’s will and other estate plan documents and identifying the person specified to serve as the personal representative. If there is no will, the court will appoint someone.
  • The personal representative works to identify all assets of the deceased, as well as to collect any income owed to the deceased and pay any debts.
  • Once all assets have been identified and debtors paid, the personal representative must then obtain a death certificate in order to distribute assets to the deceased’s heirs.
